Welcome to Fiva. These Terms of Service ("Terms") govern your access to and use of the Fiva mobile application and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age to use Fiva. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You may need to create an account to access certain features. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

4.1 Ownership. You retain ownership of content you create and share through the Service ("User Content").
4.2 License to Fiva. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and display your User Content in connection with operating and providing the Service, including for promotional purposes.
4.3 Responsibility. You are solely responsible for your User Content. We do not endorse any User Content and assume no liability for it. We may remove User Content that violates these Terms or that we deem inappropriate, without prior notice.
The Service, including its design, features, logos, and content (other than User Content), is owned by Fiva and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
Your use of the Service is also governed by our Privacy Policy , which describes how we collect, use, and protect your information. By using the Service, you consent to our Privacy Policy.
7.1 Digital offerings. Fiva may offer optional paid features, including subscription plans and consumable virtual items (“props” or similar digital content) used within the App. These are licensed for use in the Service only as described at the time of purchase.
7.2 Payment processing. All in-app purchases are processed by Apple through the App Store. You agree to Apple’s applicable terms, including payment terms and the App Store’s rules. We do not process or store your full payment card details.
7.3 Subscriptions. If you purchase a subscription, it may automatically renew for successive periods at the then-current price until you cancel. You can manage and cancel subscriptions in your Apple ID account settings (Settings > Apple ID > Subscriptions, or the App Store). Cancellation takes effect at the end of the current billing period unless otherwise required by law. Free trial and promotional offers, if any, are subject to the terms shown at purchase.
7.4 Consumables. Consumable items are virtual goods credited to your account for use in the App. They have no cash value outside the Service, are non-transferable, and cannot be exchanged for money. Use of consumables is subject to the rules shown in the App.
7.5 Pricing, taxes, and changes. Prices are displayed in the App before you confirm a purchase and may vary by region. Applicable taxes may be charged by Apple or as required by law. We may change prices or offerings; changes will apply as communicated at or before purchase where required.
7.6 Refunds and restore. Refund requests are handled in accordance with Apple’s policies and applicable law. Where the App provides a “Restore Purchases” or similar feature, you may use it to restore eligible prior purchases on your device. For billing disputes, contact Apple Support.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. FITNESS AND HEALTH INFORMATION PROVIDED THROUGH THE SERVICE IS FOR GENERAL INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL OR FITNESS ADVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIVA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
You agree to indemnify, defend, and hold harmless Fiva and its affiliates from and against any claims, damages, losses, liabilities, and expenses arising from your use of the Service, your User Content, or your violation of these Terms or any third-party rights.
We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may terminate your account at any time through the App settings or by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, disclaimers, indemnification, and limitation of liability.
Any dispute arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration in accordance with applicable arbitration rules. You waive any right to participate in class actions. These Terms are governed by the laws of the jurisdiction in which Fiva operates, without regard to conflict of law principles.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service.
These Terms constitute the entire agreement between you and Fiva regarding the Service. If any provision is found unenforceable, the remaining provisions shall remain in effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
